Terms of Service

These Terms of Service govern your use of the NOL8 website at nol8.io (the “Site”), operated by FortifAI Limited (“NOL8”, “we”, “us”, or “our”). By using the Site, you agree to these Terms.

NOL8 is part of FortifAI Limited, listed on the ASX as FTI.

1. Eligibility

The Site is intended for businesses and for users who are at least 18 years old. By using the Site, you confirm you have the authority to do so on behalf of yourself or the organization you represent.

2. Acceptable use

You agree not to:

  • Use the Site in any way that breaks the law or these Terms.
  • Attempt to gain unauthorized access to the Site, its systems, or related networks.
  • Interfere with or disrupt the Site, including by introducing malicious code.
  • Scrape, copy, or harvest content or data except as expressly permitted.
  • Use the Site to send unsolicited communications or to misrepresent your identity.

3. Intellectual property

The Site and its content, including text, graphics, logos, and software, are owned by FortifAI Limited or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to view and use the Site for your internal business purposes. You may not copy, modify, distribute, or create derivative works from the content without our prior written consent.

4. Trademarks

“NOL8” and our logos are trademarks of FortifAI Limited. You may not use them without our prior written permission. Other names and marks are the property of their respective owners.

The Site may contain links to third-party websites. We do not control and are not responsible for the content or practices of those sites. Links do not imply endorsement.

6. Feedback and submissions

If you send us feedback, ideas, or suggestions, you grant us a perpetual, royalty-free right to use them without restriction or obligation to you. Do not send us confidential information through the Site.

7. Disclaimers

The Site is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure. Nothing in these Terms excludes rights that cannot be excluded under applicable law.

8. Limitation of liability

To the maximum extent permitted by law, NOL8 will not be liable for any indirect, incidental, special, or consequential loss arising from your use of the Site. Where liability cannot be excluded, it is limited to the extent permitted by law.

You agree to indemnify NOL8 against claims, losses, and costs arising from your breach of these Terms or misuse of the Site, to the extent permitted by law.

10. Governing law

These Terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales have exclusive jurisdiction, subject to any mandatory consumer protections in your location.

11. Changes to these Terms

We may update these Terms from time to time. The updated version takes effect when posted, with a revised effective date above. Your continued use of the Site means you accept the changes.
